About Domain Desk

Domain Desk is operated by the domain owner to present domain names for sale, receive enquiries and offers, and communicate with prospective buyers.

The domain names offered for sale are managed through Spaceship, where applicable. Domain transactions are handled through Spaceship's relevant services and are subject to the applicable Spaceship terms and transaction procedures.

Offers and Sale Agreements

Offers and negotiations initiated through Domain Desk are subject to the terms applicable to the relevant transaction.

The binding effect of an offer or its acceptance depends on the channel through which it is made and the terms governing that transaction. Offers made or accepted through the Spaceship Domain Marketplace are governed by the applicable Spaceship Domain Marketplace Agreement, including its rules on binding offers and acceptance.

The relevant transaction record or written sale agreement will identify the domain and the applicable commercial terms.

Price and Transaction Terms

The agreed sale price, payment currency, applicable fees, deadlines, transfer instructions and any additional conditions will be specified in the transaction-specific sale record, written agreement or applicable Spaceship transaction interface.

Any transaction-specific terms take effect in accordance with the agreement and the applicable platform rules.

Payments, Refunds and Failed Transfers

Payments, seller payouts, refunds, transaction processing and failed-transfer procedures are handled through Spaceship in accordance with the terms, policies and procedures applicable to the transaction.

Buyers and sellers must follow the applicable Spaceship process, provide the required information and authorisations, and comply with relevant deadlines.

Domain Desk does not independently operate an escrow service or payment-processing service. Any payment, refund or transaction protection available to a buyer is governed by the applicable Spaceship terms and the specific transaction.

Domain Transfers

Domain transfers are subject to applicable registrar and registry rules, domain eligibility requirements, security restrictions and the procedures of the relevant service provider.

Both parties must cooperate with the transfer process, provide accurate information and complete any required authorisations or verification steps.

Transfer timing may depend on registrar or registry restrictions, verification requirements, domain status, security controls and other circumstances outside the seller's reasonable control.

Domain Condition and Disclaimers

Except as expressly agreed in writing, domain listings are provided for informational and sales purposes. No guarantee is made regarding a domain's traffic, revenue, search rankings, market value or suitability for a particular purpose.

Nothing in these terms excludes or limits any warranty, representation or liability that cannot lawfully be excluded or limited under applicable law.

Liability

To the extent permitted by applicable law, Domain Desk is not responsible for interruptions, processing delays, payment decisions, refund decisions or transfer procedures controlled by third-party service providers.

This provision does not exclude liability for our own acts or omissions where such liability cannot lawfully be excluded or limited.

Third-Party Terms

Spaceship's services are governed by its applicable terms and policies, including its Domain Marketplace Agreement where applicable. Buyers and sellers are responsible for reviewing and complying with the terms that govern their transaction.

Governing Law

These terms are subject to the applicable law governing the seller and the relevant transaction. Where a transaction-specific agreement specifies governing law, that agreement will apply to the extent legally effective.

Nothing in this clause limits any mandatory legal protections or rules that apply regardless of the parties' choice of law.

Changes to These Terms

We may revise these terms from time to time. The version applicable to a transaction will be determined by the terms accepted or otherwise applicable when the relevant agreement is formed, subject to applicable law and the transaction-specific agreement.
